The terms that govern Element Kit for Avada, its licensing service, and our sites.

These terms govern your use of avadakit.com, hub.avadakit.com, doc.avadakit.com, and the Element Kit for Avada plugin and licensing service (together, “the service”), operated by the team behind Element Kit for Avada (“we”, “us”). By purchasing a subscription or using the service you agree to these terms. Questions: info@avadakit.com.

Element Kit for Avada is a WordPress plugin that adds elements to the Avada theme’s builder. It requires WordPress and the Avada theme with Fusion Builder, which are licensed separately by their own vendors and are not included. Element Kit is an independent product: we are not affiliated with, endorsed by, or sponsored by ThemeFusion or the makers of Avada, and “Avada” is a trademark of its owner, used here only to describe compatibility.

A customer account is created when you purchase (you receive a set-password email) or when you register. Keep your credentials confidential; activity under your account is your responsibility. Account sharing to circumvent license limits is not permitted.

Licenses are sold as yearly subscriptions in tiers that differ only by the number of sites you may connect. All plans include all elements. Payments are processed by Razorpay; subscriptions renew automatically each year until cancelled, and you will receive advance notice of upcoming charges as required by your payment method’s rules. Current prices are shown at the time of purchase; if a renewal price changes, we notify you before the renewal charge. Cancellation and refunds are described in our Refund & Cancellation Policy.

An active subscription entitles you to install and use Element Kit on up to the number of sites your plan allows, to connect and manage those sites through your customer portal, and to receive plugin updates and support. License keys and account connections are per customer: do not share, publish, or resell keys, and do not offer the service itself (updates, keys, support) to others. Agencies may use their plan on client sites within their site limit. The plugin’s source code license is stated in the plugin package, and bundled open-source components remain under their own licenses.

We do not break live websites. If your subscription expires or is cancelled, elements already placed on your pages continue to render on the front end. What stops: plugin updates (including security updates), support, adding new Element Kit elements in the builder, and editing existing ones. Reactivating a subscription restores full functionality. Licensing checks fail open: if our service is temporarily unreachable, your sites are treated as licensed.

Active subscriptions receive plugin updates through the WordPress updater and email support at info@avadakit.com. We aim to respond promptly on business days. Support covers the plugin’s own functionality; it does not cover general WordPress, hosting, or Avada theme issues, or customization work, which we may offer separately as paid services.

Some elements are engagement tools, not security tools, and we say so in the product: for example, content gating and content protection elements deter casual access in the visitor’s browser but do not encrypt or server-protect content. Do not rely on them to protect confidential or paid material. Elements that display store activity are designed to show real data with names anonymised by default; you are responsible for how you configure them and for your own site’s legal compliance toward its visitors.

You may not use the service to break the law, infringe others’ rights, probe or disrupt our infrastructure, or circumvent licensing. We may suspend or terminate accounts engaged in abuse, fraud, or chargeback misuse, with notice where practicable.

The service is provided “as is”. We test carefully and take security seriously, but we do not warrant that the plugin is error-free or fits every environment, and we are not responsible for conflicts caused by other plugins, themes, or hosting configurations. To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential losses such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law.

We may update these terms as the product evolves. Material changes will be posted on this page with an updated date, and continued use after a change means acceptance. If you do not accept a change, you may cancel per the refund policy.

These terms are governed by the laws of India, and the courts of Mumbai have exclusive jurisdiction, without affecting any consumer rights you hold under the mandatory laws of your own country.
